Federal cabinet adopts ordinance for vaccinated and convalescent people

The Federal Cabinet decided to return to the basic rights of vaccinated and convalescent people by means of a circulation procedure. Now the Bundestag and Bundesrat must adopt the ordinance. It could then come into force at the weekend.

The Federal Cabinet has passed the ordinance on "Rights of those who have been vaccinated and those who have recovered in the pandemic". Following a resolution by the Bundestag and Bundesrat on Friday, the new regulation could come into force from the weekend.

Federal Justice Minister Christine Lambrecht (SPD) sees the law as an “important step towards normalcy”. The paper stipulates that those who have been vaccinated in convalescent people are legally equated with those who have tested negative.

Vaccinated and convalescent people should be allowed to go to shops, zoos or the hairdresser without a prior test.

In addition, the contact restrictions for them are to be relaxed and exit restrictions lifted.

The plan provides that you could meet with other vaccinated people and would no longer count towards the number of people if you meet with non-vaccinated people.

"In the future, vaccinated and recovered people will no longer have any restrictions on contact and exit restrictions"Announced Lambrecht.

Quarantine requirements changed

According to a resolution by the Bundestag and Bundesrat, the quarantine obligations for vaccinated and convalescent people are to be changed.

After returning from a trip abroad, vaccinated and convalescent people only need to be in quarantine if they are out of one Virus variant area come - from Brazil or South Africa, for example.

Mask requirement and distance requirement should remain

The obligation to wear a mask in certain places should not be changed. The distance requirement in public spaces should also continue to apply. "The success of the vaccinations does not mean that we can be careless. But The rule of law does not only apply in good weather, but is particularly important in times of crisis“, Said Justice Minister Lambrecht.

It must be clear that restrictions in a constitutional state are only possible with "good reason" in order to protect the life and health of other people. If the risk of a virus transmission by fully vaccinated and convalescents is greatly reduced, this must be taken into account in the measures. This is now being implemented.

Don't worry about checking the status

Lambrecht is not worried about checking the vaccination status. There are already enough exceptional cases in which the authorities control with a sense of proportion. Vaccinated and convalescents should carry their documents with them and make it clear:This is my right!".

Proof of a complete vaccination should be accepted on paper or digitally in German, English, French, Italian or Spanish. At least 14 days must have passed since the last vaccination.

Evidence of a positive PCR laboratory result should confirm that you have recovered. This must be at least 28 days old and no more than six months ago.

Discussions about elaboration

Several parties expressed concerns or made their vote subject to certain conditions, for example that visits to restaurants and theaters must also be possible due to equality. This is what the CSU demands, for example.

The Greens are calling for clarifications in some areas, but the draft is a step in the right direction.
