German administrative judges: curfew could fall anywhere

“I think that is possible, but we cannot yet foresee it for good. The arguments brought by the administrative court in Berlin were those that could possibly also be standardized or extended to curfew hours in other federal states, ”Seegmüller told Deutschlandfunk on Saturday.

The administrative court was not able to recognize the infection protection benefit of restricting the opening of restaurants after 23 p.m. “Of course, that does not mean that the health authorities in other countries cannot top it up and can still prove an increased benefit for infection protection. Because, of course, it always depends on how the encroachments on fundamental rights contained in the ordinances are actually justified, ”says the lawyer. In Berlin it was not enough, but whether it is enough in North Rhine-Westphalia will be seen, for example when it has to be decided, said the chief administrative judge.
